Who Is Eligible for This Waiver?

Immediate relatives of U.S. citizens are eligible for applying to this particular waiver. Relatives include:

  • Spouses
  • Parents
  • Minor children

If an immigrant has an immediate family that is a U.S. citizen, he or she can get a Green Card without leaving the United States with a process called adjustment of status. For immediate relatives, the only requirement is that the beneficiary had been “admitted or paroled” into the United States by an immigration officer.

Anyone who entered the country illegally, however, are ineligible for an adjustment of status and needs to apply at a U.S. consulate in another country. However, after departing the United States, a 10-year ban from the country is applied to the person who was there illegally. An I-601 forgives several criminal grounds of inadmissibility, such as a single conviction for simple drug possession or one or more convictions of crimes of moral turpitude.
